Applicability Definition

Applies to all coastal CCMs in the Convention Area (PNA + Tokelau - collective limit), Cook Islands, Fiji, Niue, Samoa, Tonga, Vanuatu, Australia, French Polynesia, Indonesia, Japan, NZ, New Caledonia, Philippines*, Chinese Taipei, United States, Wallis and Futuna*. As specified in CMM 2021-01 Attachment 1 Table 1 (* these CCMs had not notified limits to the Commission as at the adoption of CMM 2021-01). The limit values were based on prior notifications to the Commission, including those notified through previous CMRs.

Zone-based purse seine effort control

24. Coastal CCMs within the Convention Area shall restrict purse seine effort and/or catch of skipjack, yellowfin and bigeye tuna within their EEZs in accordance with the effort limits established and notified to the Commission and set out in Table 1 of Attachment 1. Those coastal CCMs that have yet to notify limits to the Commission shall do so by 31 December 2022.

28. Where the catch and effort limits in paragraphs 24 and 25 have been exceeded, any overage of the annual limits by a CCM or the collective annual limits of a group of CCMs shall be deducted from the limits for the following year for that CCM or group of CCMs.

1. Coastal CCM or PNA Office on behalf of PNA Parties+Tokelau notified their EEZ PS effort or catch limit or collective PNA+Tokelau EEZ effort or catch limit to the Secretariat.
2. Coastal CCM confirms in AR Pt2 that its notified EEZ limit or the PNAO confirms on behalf of PNA+Tokelau that the notified collective EEZ limit has not been exceeded and the Secretariat can verify the CCM’s reported information and confirm that the notified EEZ or collective EEZ limit has not been exceeded.

French Polynesia			17 Feb 2024: French Polynesia notified in reference to Footnote 2 that it has not established any purse seine fishery in its EEZ. For this reason, French Polynesia as a coastal participating territory, has notified so far "0" as purse seine limits within its EEZ to the Commission. However due to climate change or other socio-economic factors to be considered, French Polynesia may contemplate changes in fishing strategy in the future. Consequently and according to CMM 2023-01 para 24 footnote 2, French Polynesia notifies the Secretariat not having established purse seine fisheries in its EEZ yet, so paragraph 24 does not apply to French Polynesia.
